General Sales Conditions (GSC)

Avintage is a brand of the FRIO ENTREPRISE group.

The present general conditions of sale ("GCS") apply to all orders placed on the site www.avintage.com ("the Site"). By validating his/her order, the Customer declares that he/she has read and accepts these GSC without reservation. The present General Terms and Conditions of Sale ("GTCS") are in accordance with Article L441-6 of the French Commercial Code and apply to products sold by FRIO ENTREPRISE under a brand or trade name belonging to it or for which it ensures distribution, and form an integral part of our contractual stipulations. Placing an order implies the purchaser's full and unreserved acceptance of these terms and conditions of sale, notwithstanding any stipulation to the contrary proposed by the purchaser. FRIO ENTREPRISE reserves the right to suspend or cancel the sale, in whole or in part, in the event of force majeure, defined as any event likely to stop or reduce the manufacture of products, or the transport of goods, or to prevent the normal execution of the contract.

Object

The purpose of the GCS is to describe the terms and conditions of distance selling of goods and services between FRIO ENTREPRISE and the Customer. They express all the obligations and rights of the parties. FRIO ENTREPRISE may adapt or modify these GTC at any time. The applicable GCS are those in force on the day of the order by the Customer.

Controls

1. General

The Customer places an order in accordance with the specifications shown on the Site. Through the Site, the Customer has the option of delivery to the address of his/her choice. Any modification or cancellation of the order requested by the purchaser can only be taken into consideration if it is received in writing before shipment of the products. FRIO ENTREPRISE reserves the right, in any event, not to follow up on such requests.

2. Anti-fraud control

In order to ensure the security of transactions and to prevent payment fraud on the Internet, FRIO ENTREPRISE reserves the right to verify the reliability of the information entered by the Customer during order registration. Consequently, FRIO ENTREPRISE's Customer Relations Department may ask the Customer, by telephone and/or e-mail, for one or more supporting documents (copy of ID and proof of address). This request will have the effect of suspending the order pending transmission of these documents by e-mail to contact@avintage.com or by post to the following address: FRIO ENTREPRISE, Service Site Internet, 143 boulevard Pierre Lefaucheux, 72230 Arnage. In addition, FRIO ENTREPRISE may cancel the order in the event of non-conformity of supporting documents or failure to transmit such documents. In such a case, cancellation of the order shall not entitle the customer to any damages whatsoever.

Price

The prices of products on the Site are quoted in euros, inclusive of all taxes, but exclusive of delivery charges. Product prices are those in force at the time the order is registered by the Customer. However, FRIO ENTREPRISE reserves the right to modify its selling prices at any time before the order is taken.

Payment

According to the terms of your contract with FRIO ENTREPRISE.

Product availability and delivery

1. Conditions

Deliveries are only made in mainland France. Delivery is made either by direct handover of the product to the purchaser, or by delivery to a shipper or carrier on the premises of FRIO ENTREPRISE. Delivery charges are payable by the Customer and vary according to the type of order. They are indicated to the customer when he/she checks the availability of the product.

2. Availability and delivery time

Availability is indicated at the time the Customer consults the product. In the event of unavailability of the product ordered, the Customer will be informed as soon as possible and will have the option of cancelling the order. If an exchange is not possible, FRIO ENTREPRISE reserves the right to cancel the order and refund the sums paid. FRIO ENTREPRISE cannot be held responsible for the unavailability of a product, nor can it entitle the Customer to damages. If no delivery date is set, delivery will take place according to availability and in the order in which orders are received. Our agreed delivery times are indicative and non-binding.

3. Late delivery

Exceeding delivery deadlines may not give rise to damages, withholding or cancellation of orders in progress. No penalties or damages for late, early, partial or excess delivery will be accepted. Likewise, no penalties will be accepted for delays caused by traffic accidents, police checks or long waits on other platforms. In the event of damage during transport, this may result in partial or total refusal of the order. This situation is not our direct responsibility, and will not give rise to penalties. In the absence of damage formally notified to the carrier during the inspection of the products at the time of delivery, FRIO ENTREPRISE declines all responsibility for damage, whether in warehouses and/or sales outlets.

4. Transport and home delivery

Delivery is deemed to have taken place when the goods ordered are made available to the customer by the carrier. It is materialized by the signing of the delivery note by the Customer, who must check the goods on arrival, report any defects, or refuse the product if necessary. Once the product has been returned, FRIO ENTREPRISE will exchange the goods or refund the purchase price if the goods are out of stock for more than 14 days. Our "classic" deliveries, i.e. those offered free of charge to the customer, are made at the "doorstep", i.e. at the bottom of your building or at the entrance to your home. You must make your own arrangements to receive your parcel and transport it by your own means. Remember to measure your doors, stairs and elevators before confirming your order. Any order validated by the customer implies full acceptance of the General Terms and Conditions of Sale (check box in the shopping cart stage of the online order). Also, and in any case, a validated order for which the merchandise is taken care of by the merchandise company cannot be refused on the sole grounds that the delivery is made to the doorstep.

Product returns

1. Claims

The customer must ensure that he/she has received the correct number of packages and that the products are in good condition when the order is placed or delivered. If the product(s) delivered does (do) not conform in kind or quantity to the specifications indicated on the delivery note or invoice enclosed with the shipment, or has (have) suffered damage during transport, the Customer must fill in the delivery note legibly stating his or her reservations and also point out any damage due to transport. In the case of a product that does not conform to the order, if the delivery has been made: by express parcel: a prepaid label will be sent to the Customer by post in order to return the product(s) at our expense as soon as we receive the complaint, by a carrier: the carrier will come to the Customer's home to collect the goods by appointment. It is essential that the Customer keeps the items in their original packaging and in the condition in which they were delivered. The customer will be promptly contacted by FRIO ENTREPRISE, and will receive a new delivery free of charge and by appointment for all available products.

2. Right of withdrawal

Deadline

In accordance with articles L.121-20 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from delivery of the order to return any item that does not suit him/her, in its original packaging, and request reimbursement of the product(s) ordered from FRIO ENTREPRISE.

Terms and conditions

The right of withdrawal is exercised by registered letter with acknowledgement of receipt to the following address: FRIO ENTREPRISE, Website Climadiff, 143 boulevard Pierre Lefaucheux, 72230 ARNAGE.

Return costs for customer retraction

The customer is solely responsible for return shipping costs. Products returned postage due or cash on delivery will be refused by FRIO ENTREPRISE. If the product(s) has (have) been delivered by a carrier, the carrier will collect the product(s) from the customer's home by appointment. The cost of the carrier's visit will be deducted from the customer's refund. In any event, products must be returned in their original, unused packaging, accompanied by proof of purchase and any unassembled accessories, instructions and documentation. Refunds or exchanges assume that the product has not been damaged by the customer or returned incomplete. Refunds for returned products will be made as soon as possible, and at the latest within 30 days of retraction.

Warranties and after-sales service

1. Definition of warranty

FRIO ENTREPRISE grants the Customer a one-year national parts warranty on electrical appliances only. This warranty does not cover labor or travel. The product is guaranteed if it is accompanied by its purchase invoice. The warranty covers products in their original configuration, provided the serial number is still legible. The warranty is valid in metropolitan France.

2. Defects on unpacking

Should a defect appear on unpacking, preventing the use of the product in its expected configuration, the Customer must contact FRIO ENTREPRISE within 72 working hours. The product will then be exchanged (excluding assembly breakage and missing hardware).

3. Extended warranties

Extended warranties sold by FRIO ENTREPRISE are valid only on FRIO ENTREPRISE brand products. Extended warranties cover technical faults only. Extended warranties cover the cost of defective parts, labor costs and travel expenses in metropolitan France, excluding the islands. If necessary, a technician will be dispatched to the site in mainland France, excluding the islands.

4. Warranty exclusions

Extended warranties do not cover aesthetic or appearance parts, accessories or parts subject to wear and tear (cables, seals, filters, lamps, etc.). The FRIO ENTREPRISE warranty does not apply to: Accidental material damage. In particular, it does not cover deterioration or breakdown resulting from improper installation, assembly or use of the product, normal wear and tear or lack of maintenance. In the event of indirect damage. The FRIO ENTREPRISE warranty only covers the right to repair or replace the guaranteed product. Indirect damage resulting from breakdown or deterioration is not covered by the warranty.

Liability

FRIO ENTREPRISE shall not be held liable for any indirect damage or costs, or for any loss, in particular loss of data or information, or for any damage or costs arising from the use or inability to use the product by the Customer.

FRIO ENTREPRISE cannot be held responsible for goods which are stored inside its equipment and which may be damaged

The buyer alone is responsible for the contents of the equipment sold by FRIO ENTREPRISE. Nor can FRIO ENTREPRISE be held responsible for goods located on the purchaser's premises.

Force majeure

FRIO ENTREPRISE cannot be held responsible for non-performance of the contract due to an event of force majeure.

All facts or circumstances that are irresistible, unforeseeable and beyond the control of the parties are considered as force majeure.

Personal data

As part of your commercial relationship with FRIO ENTREPRISE, we may ask you to provide certain personal data. You will be informed whether this information is compulsory or optional.

They are only used to process your order or request (newsletter subscription, game participation, information request, etc.) and to personalize communication and product offers on the site and in our newsletters.

Your data is confidential. FRIO ENTREPRISE undertakes not to divulge it to third parties other than its subcontractors without your express consent. For example, we will only pass on your details to companies selected by FRIO ENTREPRISE whose offers may be of interest to you if you have agreed to this when you register.

Modification of the general sales conditions

In order to be valid and binding on FRIO ENTREPRISE, any modification to the present general terms and conditions of sale must be contained in a written document signed by a person expressly authorized by FRIO ENTREPRISE and referring to the present general terms and conditions of sale.

Applicable law

These terms and conditions are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

Jurisdiction clause

Any dispute arising out of or in connection with these general terms and conditions of sale shall be submitted to the Commercial Court of Le Mans, to which the parties expressly assign exclusive jurisdiction. This applies irrespective of the methods of purchase or payment provided for in these agreements, even in the event of multiple defendants or the introduction of third parties, and irrespective of the place of delivery of the goods ordered.

Mediation of consumer disputes

In accordance with articles L611-1 et seq. and R612-1 et seq. of the French Consumer Code, the Consumer may have recourse to free mediation in the event of any contractual dispute relating to the performance of the sales contract and/or the provision of services that cannot be resolved by means of a complaint previously lodged with our customer service department. He/she should contact the Association Nationale des Médiateurs (ANM) either by post at 62 rue Tiquetonne 75002 PARIS or by e-mail by filling in the online referral form at the following address www.anm-conso.com. For online purchases, the consumer may also visit the website of the European platform for online dispute resolution.
